A PlayStation 4 owner in America has dragged Sony to court over Killzone: Shadow Fall and its graphics claims stating that the company is employing ‘deceptive marketing’ tactics to promote its game.
Sony, while marketing Killzone, claimed that the game would run at a native 1080p resolution – the highest resolution possible on a gaming console at the moment. If one is playing the game in single player mode, it does run in 1,920 x 1,080 resolution just fine; however, in case of multiplayer mode the resolution dips to just 960 x 1,080.
Killzone developer Guerrilla Games have already admitted that the game doesn’t run on native 1080p and that they use ‘temporal reprojection’ to create an illusion that the game is running on native 1080p.
Douglas Ladore has filed the lawsuit in Northern District California court alleging that Sony has used technological shortcut to provide ‘subjectively similar’ results”. The lawsuit further states that Sony hasn’t updated the packaging of the game to reveal that actual resolution of the game.
The allegations in the suit include negligent misrepresentation, false advertisement, unfair competition and fraud in the inducement with damages exceeding a whopping $5 million.
An interesting bit about this lawsuit is that Ladore has sought the services of law firm Edelson PC – a company that has previously filed cases against Sony and EA in 2011. The law firm has also filed cases against Sega and Gearbox.
